Owners' association: how to complain about it or its manager

Prepared from the official page

Ittihad Al-Mullak is the common name for the owners' association the Law of Ownership, Subdivision and Management of Real Estate Units requires once a shared building has 3 or more unit owners; the Real Estate General Authority registers and regulates it. For a dispute with it or its manager, report in its «البلاغات» (Complaint) service via Nafath, or call 199011.

Steps

  1. Read your association's statutes first: every owners' association has statutes that set the rules for the general assembly and the manager, the use of common parts and how fees are set. Owning a unit in the building counts as accepting those statutes and the general assembly's decisions (Articles 12 and 15).
  2. Check that the disputed decision is valid: general assembly decisions are valid when approved by owners holding at least three quarters of the total area of the subdivided units, unless the statutes set a higher share (Article 18).
  3. Ask for the financial documents: the manager prepares the financial statements and an activity report within 3 months of the end of the association's financial year, and must give REGA and every owner a copy within one month of preparing them (Article 20).
  4. Ask for a general assembly meeting: it may be called at any time at the request of the manager, the auditor, or owners representing at least half of the total number of subdivided units. It meets at least once a year, within the 3 months after its financial year ends (Article 18).
  5. If the dispute is about fees: every owner must pay their share of the costs of managing the building and maintaining the common parts, and may not give up their share in the common parts to avoid paying (Article 24). The manager's decisions and contracts about the building become, once approved by REGA, an enforceable instrument against the owners (Article 21).
  6. If the manager caused you harm: the manager must compensate the association or the owners for harm caused by breaching the Law or the statutes (Article 19).
  7. According to a REGA news item of December 2023, the operations carried out on REGA's Mullak (مُلاك) platform include nomination and voting for the association's presidency and management, and billing of association fees.
  8. To file the report: open REGA's website rega.gov.sa, then «تواصل معنا» (Contact Us), then «البلاغات» (Complaint), sign in with the National Single Sign-On (Nafath), then submit your report of the violation or complaint. Service hours: Sunday to Thursday, 8:00 AM to 4:00 PM.
  9. For questions, call REGA's unified number 199011.
  10. The Law sends some disputes to the competent court, including an affected owner's objection to re-subdividing the building or changing its uses (Article 3), and disagreement over what the general assembly decides if the building collapses (Article 29).
  11. If your dispute is with your landlord rather than the owners' association, see Dalni's guide on complaining about a landlord in Ejar.

Have ready:

  • Your unit's title deed or other proof that you own it
  • The building's name and address and the owners' association's name
  • A copy of the disputed decision, invoice or meeting minutes
  • Your messages with the manager or the association's president, and photos of the problem if any
  • The Nafath app; you type your ID or Iqama number only on REGA's website
