Huroob: when is an absence report filed, and what are my rights?

Prepared from the official page

Huroob (absence report) is the Ministry of Human Resources’ “work interruption report”. The employer files it on Qiwa for an expatriate worker with no documented Qiwa contract absent without legitimate reason over 30 separate days a year or over 15 days in a row. The worker then has 60 days to transfer or take final exit. Domestic workers: Musaned.

Steps

  1. In the private sector: the employer or its representative files a “work interruption report” request on the Qiwa platform and chooses the reason: the worker was absent without a legitimate reason for more than 30 separate days in one year, or more than 15 days in a row. This procedure is in the Ministry's procedural guide for workers without an electronically documented contract.
  2. Conditions for filing: the establishment is active, the expatriate worker has no documented contract on Qiwa, the worker is on the job, and the worker's work permit and residence permit are valid for at least 60 days.
  3. After the report is filed, both parties are told by text message; the worker is removed from the establishment's records and is not counted in Nitaqat; the establishment cannot withdraw the report; and the worker's status becomes “interrupted from work” (منقطع عن العمل).
  4. The worker has 60 days from the report to move to another establishment, if more than 12 months have passed since entering Saudi Arabia (the new employer requests the transfer, the worker approves it and the Ministry approves the request), or to issue a final exit visa from their Absher account.
  5. If 60 days pass with no transfer or departure, the system accepts neither a final exit nor a transfer, the worker's status stays “absent from work” (متغيب عن العمل), and the worker is in breach of the rules and bears the consequences.
  6. The report does not affect the employer's right to bring a claim against the worker before the judicial authorities, as stated in the undertaking the employer accepts when filing it.
  7. Under the Labour Law, the employer may end the contract without end-of-service benefit, notice or compensation if the worker is absent without a legitimate reason for more than 30 days in a contract year or more than 15 days in a row, after a written warning at 20 days of absence in the first case and 10 days in the second, and after letting the worker state objections (Article 80).
  8. If you are the worker and disagree with the employer about ending the contract, or have unpaid wages and dues, file an amicable settlement request with the Ministry of Human Resources and Social Development; the steps are on the Dalni page “Amicable settlement”. The Ministry's number is 19911, Sunday to Thursday, 8 am to 5 pm.
  9. For domestic workers: the employer signs in to Musaned, opens the “Workers” page and selects the domestic worker, then “Submit a request or report”, then reports the worker's absence from work and sends the request.
  10. If a domestic worker stops coming during probation, the employer informs the authorities and obtains an absence report (بلاغ انقطاع). In the first two years the recruitment office bears the worker's return cost, and during probation it refunds the recruitment costs minus the time the worker stayed, per the contract formula. Complaints about the office: Dalni page “Musaned complaint”.
  11. Personal disputes between a domestic worker and the employer go to amicable settlement of labour disputes, according to the Musaned FAQ.
