Labour court: how do I file a labour claim after amicable settlement?

Prepared from the official page

The labour court comes after free amicable settlement at HRSD. If no settlement is reached within 21 working days of the first session, a failed-settlement record is issued and you file at the competent labour court via the statement of claim service on Najiz. Claims are not accepted 12 months after the job ends, unless the court accepts an excuse.

Steps

  1. Start with an amicable settlement request on the HRSD e-services portal. It is free. The steps are on the Dalni amicable settlement page.
  2. Attend the session on time: if the claimant does not attend, the claim is saved, and he may reopen it as long as 21 working days have not passed.
  3. If a settlement is reached: a settlement record is issued, and you can print it from the claims service on the ministry's portal.
  4. If there is no agreement: a record that the dispute could not be settled amicably is issued. Keep it.
  5. After that you may file the claim at the competent labour court under the procedures approved by the Ministry of Justice, through the statement of claim service (صحيفة دعوى) on Najiz, which lets you file a claim at one of the courts, including the labour courts.
  6. Watch the deadline: the labour courts do not accept a claim for a right under the Labour Law or the employment contract after 12 months from the date the work relationship ended, unless the claimant gives an excuse the court accepts or the defendant acknowledges the right (Article 234).
  7. Labour claims are heard as a matter of urgency (Article 234).
  8. Judicial costs: the Ministry of Justice judicial costs calculator page states that the employee or worker in labour cases is exempt from judicial costs.
  9. For help with amicable settlement call 19911; for Ministry of Justice services, the justice contact centre is 1950.
  10. You type your details only on the ministry's portal and on Najiz. Dalni does not file the claim for you and does not ask for your details.

Have ready:

  • The employment contract if there is one, or other proof of the contractual relationship
  • The documents for your type of claim
  • The record that the dispute could not be settled amicably
  • A power of attorney (wakala) if an agent files for you
